Waiver of liability against LI Float LLC

LI Float LLC, makes all reasonable efforts to ensure our clients are comfortable, in a clean and safe environment. To help us maintain this level, please read and understand the following terms of use.

 

Waiver of Liability

Assumption of the risk and hold harmless agreement

  1. In consideration for receiving permission to participate in any LI Float LLC activity, program or other event (hereinafter referred to as “Activity”), I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE LI Float LLC, or any "The Float Place" location, it’s subsidiaries, officers, agents, or employees (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such ACTIVITY, while on or upon any of the premises where the activities are being conducted, REGARDLESS OF WHETHER SUCH LOSSES ARE CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law;

     

  2. I am fully aware of the many risks and hazards connected with the activities of LI Float LLC, or any "The Float Place" location, including but not limited to slipping and falling due to the fact that this activity involves the utilization of large amounts of water, medical complications and a multitude of other health and safety issues, and I am aware that such activities include the risk of injury and even death, and I hereby elect to voluntarily participate in said activities, knowing that the activities may be hazardous to my property and me and agree to this WAIVER OF LIABILITY. I understand that LI Float LLC, or any "The Float Place" location, does not require me to participate in this activity. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such activities, and I realize I am waiving any claims due to my ASSUMPTION OF THE RISK, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES or otherwise, to the fullest extent allowed by law;

     

  3. I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage, or costs, including but not limited to any court costs and attorney’s fee that Releases may incur due to my participation in said activities, WHETHER CAUSED BY NEGLIGENCE OF RELEASEES or otherwise, to the fullest extent allowed by law;

     

  4. It is my express intent that this Waiver of Liability, Assumption of the Risk and Hold Harmless Agreement shall bind the members of my family and spouse, as well as my heirs, assigns and personal representatives, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE the above named RELEASEES. I hereby further agree that this Waiver of Liability, Assumption of the Risk and Hold Harmless Agreement shall be construed in accordance with the laws of the State of New York an that and mediation, suit, or other proceeding must be filed or entered into only in New York and the Federal or State courts of New York. Any portion of this document deemed unlawful or unenforceable shall be stricken without any effect on the remaining provisions.

  5. CANCELLATION POLICY

    The Float Place maintains a firm 24-Hour Cancellation Policy. Failure to cancel or reschedule prior to 24 hours, will result in a $35.00  fee. If you do not cancel or reschedule your appointment, and don't show up, you will be charged the full amount for a Float appointment ($79.95) or Sauna appointment, or a credit will be removed from your account.  

    Please keep in mind that when you book an appointment, that is your time. We honor the decision you’ve made toward increasing your health and support you in your journey. We are here for you, and do not double book appointments. With a limited amount of time slots for appointments in an given workday, every appointment is extremely valuable. Your co-operation is greatly appreciated!

Sanitation and safety are the top priorities at “The Float Place”. Consequently, please do not wear slippers or shoes in the float suite. Please do not add any perfumes, oils or salts into the water. Do not smoke, drink, eat, or release any bodily fluids in the float suite. Please turn your cell phone to silent or turn it off. By signing this form, you are indicating you have read, understand and agree to the terms, and the waiver other side of this page, for this float and future floats. We hope you enjoy your float, and all those that follow.? 

IN SIGNING THIS AGREEMENT, I ACKNOWLEDGE, AND REPRESENT THAT I am physically fit and/or am medically able to participate in this ACTIVITY, I have read the foregoing Waiver of Liability, Assumption of the Risk and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by the same.
