WAIVER AND RELEASE OF LIABILITY INCLUDING REFUND POLICY
By signing this Waiver and Release of Liability I assume all risks for my child who will be participating in OOZAPALOOZA Inc DBA Oozapalooza (“Oozapalooza”) slime crafting activities (the “Activities”). Without signing this waiver, my child is unable to interact, create or participate in any of the Activities.
By signing this Waiver and Release of Liability, I confirm that I am (i) legally an adult under laws of the State of Nevada, or (ii) the parent or legal guardian of the participant(s) named below.
By signing this Waiver and Release of Liability, I confirm that all participant(s) are of physical ability to participate in the Activities, and I am legally competent to understand and complete this Waiver and Release of Liability. I hereby execute this Waiver and Release of Liability without coercion.
By signing this Waiver and Release of Liability, I acknowledge I am aware and understand the Activities may pose risk of personal injury to participants, particularly those with extra sensitive skin or allergies. I acknowledge that it is my responsibility to inform Oozapalooza of any allergies, skin conditions or medical conditions of the participant(s). I understand that the participant(s) should not play with slime if allergic to non-toxic school glue, lotion, baby oil, shave foam, borax powder, air-dry clay, food coloring, acrylic paint, glitter, mica powder, plastic snow, styrofoam, or fragrance oils. Likewise, I understand that the participant(s) should not play with slime if they have an open cut or current skin rash. I understand this product should not come in contact with the face, eyes, mouth or nose.
By signing this Waiver and Release of Liability, I undertake and assume this risk for the participant(s) named below. I acknowledge that I am aware and understand that none of the products used for the Activities are consumable by mouth and that products should not be eaten. I acknowledge that I am award and understand that it is always my responsibility to inform and monitor the participant(s) to ensure that this product is not consumed
By signing this Waiver and Release of Liability, I acknowledge that Oozapalooza is not responsible for any potential exposure to the Coronavirus/COVID-19 to myself, the participant(s) and/or members of my party. I confirm that I and no participant or member of my party is experiencing any symptom of illness such as a fever, cough, shortness of breath or difficulty breathing, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell. I acknowledge that I, along with the participant(s) and members of my party, must comply with all set procedures to reduce the spread of COVID19 while engaged in the Activities.
By signing this Waiver and Release of Liability, I confirm that the participant(s) is/are of age 5 or older. I understand that if is the participant is/any of the participants are under the age of 5 they will be unable to participate in any Activities.
By signing this Waiver and Release of Liability, I confirm that I, the participant(s) named below, and our respective heirs, assigns, representatives, and next of kin hereby (i) release Oozapalooza and its ownership from any liability associated with the Activities, and (ii) agree to forever defend, indemnify, and hold harmless Oozapalooza and its ownership, their respective heirs, assigns, representatives, and next of kin, from and against any and all injuries, liabilities, or damages which are in any way connected with (a) participation in the Activities, (b) arising from the conduct of other participants, or (c) my/participant(s)’s own negligence.
This Waiver and Release of Liability is to be governed pursuant to the laws of the State of Nevada.
During the course of my visit I understand that myself, the participant(s) and/or members of my party may be video recorded and/or photographed for use by Oozapalooza. I acknowledge that Oozapalooza may use and publish photographs and videos taken of me or the participant(s) (the “Likeness”) in connection with marketing materials, including web-based publications and on social media platforms (the “Promotional Materials”). I understand that it is my responsibility to notify Oozapalooza promptly if I do not wish for my or the participant(s)’s Likeness to be shared on any of its Promotional Materials.
Refund Policy: A $10 non-refundable/non-transferable deposit is required for "daily reservations" that goes towards the cost of your in studio purchase. It cannot be transferred to a different date or time. A 50% deposit is required for all other services booked. Deposits are refundable up to 15 days before your scheduled event, unless canceled by Oozapalooza. Refunds will not be issued if cancellation request is placed less than 15 days before your event. Last minute events booked less than 15 days in advance forfeits their ability to receive a refund of their deposit. Refunds will not be issued for services already rendered. A cancellation or change request MUST be made via email at support@oozapalooza.com.. A refund will not be provided for slime crafted in our studio after a crafting session. All handcrafted slime purchased is final sale. Due to to the degradable nature of the product and for sanitary reasons, slime cannot be returned, Even if it is unopened. Oozapalooza is not responsible for your slime product once it leaves our studio. It is the duty of parents to monitor their child with their slime during slime play at all times. Please note: Oozapalooza will not provide a remedy to slime incidents that occur outside our studio.
