Release and Waiver of Liability in relation to Assumption of Risk, Coronavirus/COVID-19, and Indemnity Agreement

This waiver & declaration must be completed prior to or upon visiting VR Wonderland and before participating in any activity.

By participating in the virtual reality experience at VR Wonderland, I am indicating, that I understand the nature of this activity and that I am qualified, in good health, and in proper physical condition to participate in such activity. I acknowledge that if I believe the experience is unsafe, I will immediately discontinue participating in the activity.

I am voluntarily participating in the aforementioned activity and I am participating in the activity entirely at my own risk. I am aware of the risks associated with participating in this activity, which may include, but are not limited to, physical or psychological injury, pain, suffering, temporary or permanent disability, economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my own or others’ negligence, or the condition of the activity. Nonetheless, I assume all related risks, both known and unknown to me, of my participation in this activity.

I hereby release, discharge, and covenant not to sue VR Wonderland, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, partners, manufacturers, lessors, affiliates, and if applicable, owners and lessors of premises on which the activity takes place, (each considered one of the "Releases" herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence or the "Releases" or otherwise, including negligent rescue operations; and I further agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the releases, I will indemnify, save, and hold harmless each of the releases from any loss, liability, damage, or cost which any may incur as the result of such claim.

In the event that I should require medical care or treatment, I agree to be financially responsible for any cost incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

And, in the event that any damage to equipment or facilities occurs as a result of my willful actions, neglect or recklessness, I acknowledge and agree that I may be held liable for any and all costs associated with such actions.

I will not hold VR Wonderland or its affiliates responsible for lost or stolen personal property.

Parental consent for minors under 18

Children must be at least 5 years of age to participate

And I, the minor's parent and/or legal guardian, understand the nature of the above referenced activities and the minor's experience and capabilities and believe the minor to be qualified to participate in such activity. I hereby release, discharge, covenant not to sue and agree to indemnify and save and hold harmless each of the releases from all liability, claims, demands, losses, or damages on the minor's account caused or alleged to have been caused in whole or in part by the negligence of the releases or otherwise, including negligent rescue operations, and further agree that if, despite this release, I, the minor, or anyone on the minor's behalf makes a claim against any of the above releases, I will indemnify, save and hold harmless each of the releases from any litigation expenses, attorney fees, loss liability, damage, or cost any release may incur as the result of any such claim. In the event that my child causes any damage to equipment or facilities as a result of my child’s willful actions, neglect or recklessness, I acknowledge and agree that I may be held liable for damages associated with such actions mentioned above. And, in the event that my child does not adhere to or openly disregards instructions from employees or volunteers of VR Wonderland, I understand that my child may be refused service. I represent that I have full authority as parent or legal guardian to bind the minor participant to this agreement.

Media Release Consent

I am okay with having photographs or videos taken of me. I am okay with receiving newsletter via email.

Upon entering this area, I knowingly give my consent for photograph(s) and/or video(s) taken of me during the course of my presence to be used for publicity purposes: on the VR Wonderland website, in brochures and flyers, social media outlets, news releases, and in presentations to future prospective program participants. I understand that I will receive no compensation for such uses. I retain the right to have any photograph(s) and/or video(s) discontinued from use in any or all of the above venues upon request, and if, at any time, I wish my photograph(s) and/or video(s) to be discontinued from any of the above, it is my responsibility to contact VR Wonderland to make this request. In addition, I also knowingly give my consent for my email to be used by VR Wonderland for communications, newsletters, and marketing promotions purposes and that it is my responsibility to unsubscribe from such promotions, should I choose to do so.

COVID-19 Liability

The novel coronavirus, COVID-19 has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is known to spread mainly by contact from person to person. Consequently, local, provincial and federal governmental authorities recommend various measures and prohibit a variety of behaviors, in order to reduce the spread of the virus. At VR Wonderland, we commit ourselves to comply with the requirements and recommendations of national, provincial, local public health and other governmental authorities, and to put in place and adopt all necessary measures to that effect. However, VR Wonderland cannot guarantee that you (or your child, if participant is a minor/ or the person you are the legal guardian of) will not become infected with COVID-19. Further, attending the activities at VR Wonderland could increase the risk of you (or your child, if participant is a minor/ or the person you are the legal guardian of) contracting COVID-19, despite all preventative measures put in place.

By signing this document,

1. I acknowledge the highly contagious nature of COVID-19 and I voluntarily assume the risk that I (or my child, if participant is a minor/ or the person I am the legal guardian of) could be exposed or infected by COVID-19 by participating in VR Wonderland’s activities. Being exposed or infected by COVID-19 may particularly lead to injuries, diseases or other illnesses;
2. I declare that I (or my child, if participant is a minor/ or the person I am the legal guardian of) am participating voluntarily in VR Wonderland’s activities;
3. I declare that neither I (or my child, if participant is a minor/ or the person I am the legal guardian of) nor anyone in my household, have experienced cold or flu-like symptoms in the last 14 days (including fever, cough, sore throat, respiratory illness, difficulty breathing);
4. If I (or my child, if participant is a minor/ or the person I am the legal guardian of) experience, or if anyone in my household experiences any cold or flu-like symptoms after submitting this declaration, I (or my child, if participant is a minor/ or the person I am the legal guardian of) will not attend any of VR Wonderland’s activities until at least 14 days have passed since those symptoms were last experienced;
5. I (or my child, if participant is a minor/ or the person I am the legal guardian of), nor has any member of my household travelled to or had a lay-over in any country outside Canada, or in any Province outside of Ontario, in the past 14 days. If I (or my child, if participant is a minor/ or the person I am the legal guardian of) travel, or if anyone in my household travels, outside the Province of Ontario after submitting this declaration, I (or my child, if participant is a minor/ or the person I am the legal guardian of) will not attend any of VR Wonderland’s activities until at least 14 days have passed since the date of return;
6. I (or my child, if participant is a minor/ or the person I am the legal guardian of) agree to the requirements and recommendations of National, Provincial and local Public health and other governmental authorities and to those special safety regulations put in place by VR Wonderland as it pertains the Covid-19 Coronavirus and to adopt all necessary measures to those effects;
7. I (or my child, if participant is a minor/ or the person I am the legal guardian of) agree that, by filling out and signing this waiver and agreeing to the terms and conditions set out in it, I am giving up my legal rights to sue VR Wonderland and its officers and directors, in the event that I (or my child, if participant is a minor/ or the person I am the legal guardian of), contracts the Covid-19 Coronavirus.

This document will remain in effect until further notice, as per the direction of the national, provincial and local government and health officials, determines that the acknowledgments in this declaration are no longer required. This document is in addition to and does not replace all other VR Wonderland waivers.

If participant is a minor under 18, I certify that I am the parent or legal guardian of the minor and confirm that the information I entered is accurate and true. I am at least 18 years old and I have read and agree to the terms of the above agreement. By signing my full name below, I am certifying this waiver document just as if I would have physically signed it if it was on paper.
