RELEASE WAIVER AND INDEMNIFICATION rev. 11/23
PLEASE READ CAREFULLY
In consideration of The Riding Academy of NJ, Inc. ("RANJ"), furnishing services, facilities and/or equipment to enable me to participate in the motorcycle training classes they offer, I and my parent/legal guardian agree as follows:
I and my parent/legal guardian understand and acknowledge that:
a) risks and dangers exist in my use of motorcycles and motorcycle equipment and my participation in the motorcycle training class activities;
b) my participation in such activities and/or use of such equipment or facilities may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability;
c) these risks and dangers may be caused by the negligence of the owners, employees, officers, or agents of RANJ, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of natures or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes;
d) by my participation in these activities and/or use of equipment or facilities, we hereby assume all risks and dangers and all responsibility for any loses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers or employees of RANJ or by any other person;
e) if I am required to wear corrective lenses while driving, it is my responsibility to wear corrective lenses while riding a motorcycle during the class I am registered for;
f) after I have been shown how to properly strap and secure a motorcycle helmet, it is my responsibility to make sure that the motorcycle helmet I am wearing is properly and securely attached on my head while riding a motorcycle during the class i am registered for;
g) I and my parent/legal guardian hereby consent to and permit any photographs and/or videos of me taken during the class I am registered for can be used by RANJ on their website, their social media pages, and their promotional materials for marketing and/or entertainment purposes;
h) if I do not have all the protective riding gear required to participate in the riding portion of the class I am registered for namely, a DOT-compliant helmet, eye protection, a long sleeve shirt or jacket, jeans or material of equivalent or better durability than jeans with no holes in the pants (no sweat pants, leggings or light material pants are permitted), sturdy over-the-ankle footwear, and full-fingered gloves, I will not be allowed to participate in the riding session(s) of the class. I acknowledge that I will receive a partial refund from RANJ and will not be allowed to attend another class unless I pay the full course price for another class again;
i) For safety reasons, it is imperative that students are able to read, speak, and understand English. I acknowledge that I read, speak, and understand the English language. In the event that my ability to communicate in English, as I have stated, is limited, I will have someone with me to interpret what the instructor(s) say. If the instructor(s), in the instructor(s) exclusive opinion and decision, believes that he/she is not able to communicate with me, I will not be allowed to participate in the riding sessions of the class I am registered for. I acknowledge that I will receive a partial refund from RANJ and will not be allowed to attend another class unless I pay the full course price for another class again;
j) I and my parent/legal guardian certify that we have read RANJ's entire Refund Policy, which is posted on the RANJ website on the "Policies" page under "Refunds", and agree to all the terms and conditions;
k) I and my parent/legal guardian certify that we have read the entire course page for the course I am taking (IME, BRC1, BRC2, APRC, TBC, CRSC, or the SRSC) that is posted on the RANJ website;
l) I understand and agree that if I hit my head on the ground, I may be removed from the class because of the possibility of a concussion;
m) I and my parent/legal guardian understand and agree if I use my own or my parent/legal guardian's motorcycle or scooter for the class, I and my parent/legal guardian are solely responsible for any damage to the motorcycle or scooter. We also hereby certify that there is liability insurance coverage on the motorcycle or scooter and the documents to prove it;
n) I and my parent/legal guardian herby certify that I have health insurance coverage;
o) I understand that if I can not get on and off an RANJ training motorcycle, turn it around and maneuver it under my own power, I will be counseled out of the class and receive a partial refund.
p) RANJ reserves the right to remove a student from the class if they are using their phone during the course. Phone use is permitted during the breaks.
OTHER TERMS: I and my parent/legal guardian fully understand and agree that (a) this Release is intended to be as broad and inclusive as permitted by the laws of the State in which Training Activities are conducted; (b) if any portion of this Agreement is for any reason held invalid or legally unenforceable, then the balance shall, notwithstanding, continue in full force and legal effect; and (c) I and my parent/legal guardian have had the opportunity to ask any questions about this Agreement and we fully understand its terms and meaning.
I and my parent/legal guardian, on behalf of myself, my personal representatives and my heirs hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify RANJ and its owners, agents, officers, and employees from any and all claims; suits or causes of action for bodily injury, property damage, wrongful death, loss of service or otherwise which may arise out of my use of motorcycles and motorcycle equipment or my participation in the motorcycle training activities.
I and my parent/legal guardian specifically understand that we are releasing, discharging, and waiving any claims or actions that we may have presently or in the future for the negligent acts or other conduct by RANJ and its owners, agents, officers, or employees.
I and my parent/legal guardian have carefully read and fully understand all the provisions of this waiver and general release and by signing it agree it is our intention to assume all risks and to exempt and relieve RANJ, MSF, Montclair State University ("MSU"), the State of New Jersey, the owners and manufacturers of the training motorcycles and equipment used for the course from liability for personal injury, property damage, or wrongful death, or any other suits or causes of action caused by negligence or any other cause.
