WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
As consideration for being allowed to enter the play area and/or participate in any party and/or program and/or event at Summit Play Village, the undersigned, on his or her own behalf, and on the behalf of the participant, if any, identified below (the “Participant”), acknowledges, appreciates, understands, and agrees to the following:
1. LEGAL COMPETENCY AND REPRESENTATION
I affirm that I am at least 18 years of age and legally competent to sign this agreement. I am the parent, legal guardian, or authorized adult responsible for the minor child(ren) named below. I execute this agreement voluntarily and without coercion.
2. ASSUMPTION OF RISK
Participation in indoor play and group activities involves known and unknown risks, including but not limited to contusions, fractures, scrapes, cuts, bumps, allergic reactions, exposure to bacteria, fungi, viruses (including COVID-19), or other communicable diseases, and even paralysis or death. I understand and accept all such risks voluntarily for myself and child(ren) in my care. I acknowledge that socks are required at all times on the play floor.
3. RELEASE OF LIABILITY
I hereby RELEASE, WAIVE, and DISCHARGE Summit Play Village, its owners, managers, agents, staff, contractors, volunteers, insurers, landlords, and affiliates ('Released Parties') from any and all claims, demands, or causes of action related to injury, illness, loss, or damage arising from our participation—EXCEPT where such loss results from the gross negligence or willful misconduct of the Released Parties.
4. INDEMNIFICATION AND LEGAL COSTS
I agree to DEFEND, INDEMNIFY, and HOLD HARMLESS the Released Parties from any loss, damage, liability, or cost (including legal and defense fees) that may arise due to our actions or omissions while at Summit Play Village.
5. INSURANCE DISCLAIMER
I certify that I have adequate medical and liability insurance to cover any injury, sickness, or damage that I or my child(ren) may cause or suffer while at Summit Play Village. If not, I agree to bear full financial responsibility for any such expenses.
6. HEALTH AND SCREENING COMPLIANCE
I agree to comply with all posted rules and staff instructions. I consent to Summit Play Village conducting health screenings, such as temperature checks. I understand that entry may be denied or we may be asked to leave the premises if symptoms of illness are present.
7. MEDICAL AUTHORIZATION
In case of emergency, I authorize Summit Play Village staff to seek and obtain medical treatment for me or my child(ren). I assume full responsibility for all associated costs.
8. SUPERVISION & CONDUCT
I acknowledge that Summit Play Village is not a licensed childcare provider. I am solely responsible for supervising my child(ren) at all times unless otherwise stated in writing.
9. RECURRING PARTICIPATION / MULTI-VISIT USE
This waiver applies to today’s visit and all subsequent visits for a period of twelve (12) months. I agree to renew this waiver annually.
10. MEDIA RELEASE
I understand that entry, by myself and the named Participant, into a Summit Play Village location constitutes consent for Summit Play Village to use any film, video, or likeness of me and the Participant for any purpose whatsoever, without payment to us.
11. DISPUTE RESOLUTION AND JURY WAIVER
Any dispute arising from this waiver shall be resolved by binding arbitration under the rules of the American Arbitration Association. Arbitration will be held in Jackson County, Missouri or within 25 miles of Summit Play Village. If arbitration is not pursued, I waive the right to a jury trial.
12. SEVERABILITY
If any provision of this agreement is found invalid or unenforceable, the remaining provisions will remain in effect.

I have read and understood this Waiver of Liability and agree to its terms voluntarily on behalf of myself and any minor participants listed above.
