Video & Photography

  1. Photography and or video will begin at the specified time in the contract. Customer agrees to cooperate fully and understand that without full cooperation by customer, satisfaction cannot be guaranteed.

  2. Clients are responsible for providing a shot list and schedule for photon video to follow. Client understands that without either of the 2 full satisfaction can not be guaranteed. 

  3. Lessor Cancellation of Reservation or Event:  Photo and Video contract will be canceled if two consecutive months have passed with no payment(s) or if no arrangement(s) have been made between the client and service provider. A minimum payment of $200 per month is required. Service provider will cancel any reservation at any time if it appears that they will be unable to meet the expectations of the client or if  there are any violation of the agreed rules and regulations by client or if monthly  payments are not received by agreed time. All deposits and moneys received will be retained by service provider and forfeited by client in the event of cancellation or change in date regardless of the reason. Any monies or payments made received for that contract will be forfeited. Change of date is subject to venue approval and availability and is charged an additional fee that will be decided by the service provider.

  4. Delivery time of final products can range from 4 - 16 weeks. Clients must select images and complete necessary steps for service provider to complete their project. 

  5. It is understood and agreed that we cannot guarantee to produce any photo/video of any specific object(s), situation(s), person(s), or event(s) or in combination thereof, taken in the performance of the duties and/or services specified in this assignment.

  6. We have the right to assign any photographer(s)/videographer(s) for this assignment.

  7. We reserve the right to use the originals negatives/digital/tapes and/or reproductions for display, publication or other purposes. Raw photos and video are not included in the services provided. 

  8.  On its own behalf and on behalf of the subject: Client acknowledges that he/she is familiar with the Company’s portfolio and is requesting services with knowledge of the company’s style and understands that the Company’s work is constantly evolving; that the Company's services are of a unique and artistic nature; that the photos and or video may be different from photos and or video done by the company in the past; and that in creating the photos or videos we shall use our own creative artistic judgment to create images consistent with our personal judgment to create images and videos consistent with our vision of the event, which may be different from the clients and or the subject’s vision of the event. Accordingly, client acknowledges that the photos or videos shall not be subject to rejection on the basis of taste or esthetic criteria.

  9. The client has critically viewed samples of Service Providers video and/ photography work and hereby grants full editorial and production control to Service Provider for all aspects of the production and post-production services for the event. In the event a particular segment of the event is either not recorded, partially recorded, or not a part of the edited master tape, it is at the sole discretion of the service provider as the exclusive producer of the event productions and video recording. 

  10. We take utmost care with respect to the exposure, editing, duplication and delivery of the photo/video products and services offered. However in the event that a customer is still not fully satisfied, no refund is given. It is recommended that customer view and examines all aspects of video/photo products. Complete samples available upon request.

  11. In the event that your photos are damaged during shipping we will do our best to replace them in time for the event. If the photo is not received in time we will print out a additional photo for the event date. We are not responsible for shipping damages and delays.

  12. For any pre or post wedding photo sessions clients will receive 15-20 edited images for personal use. They may print, edit, distribute as they please. Event Photography of 4+ hrs will receive anywhere from 300-800 Edited images. 

  13. A payment of 30% of the invoice price is required with this contract. This amount is applied toward the total contracted amounts. Balance must be paid in monthly payments and must be paid in full two weeks prior to the event date.

  14. Customers are required to pay a minimum monthly payment of $200 every month. Invoices with that go 2 months with no payment will be automatically canceled. 

  15.  Customer’s cancellation or change of date will be ground for forfeit of moneys received for that date. A fee of $250 is required for changing the service date and is subject to availability.

  16. All personal property provided by client to service provider for utilization in the pre or post production of their video/photos is received by Service Provider at the complete and total risk of the client. Service Provider is ultimately not responsible for anything left but will make every effort to ensure the safekeeping of a client’s personal property while in its possession and return same to client upon delivery of the edited master copy tape/final photo package.

  17. In the event that photographer/videographer was unable to fulfill this contract due to illness or emergency, liability is limited to refund of the monies paid for the particular service or hour(s) of service affected.

  18. In the event of equipment or processing failure when photographs/videos/audios are produced, liability is limited to partial refund of the monies paid for this particular service or hour(s) of service affected.

  19. We reserve the right to retain all negatives/master tapes and copyrights thereof, indefinitely.

  20. For people who wear glasses, it is recommended to remove them when being photographed or they may cause glare.

  21. Photos, USB and other materials not picked up by two months after function may no longer be available and may be subject to reediting fee. YOU MUST PICK OUT YOUR EVENT PHOTOS BEFORE YOU CAN RECEIVE YOUR USB. If a customer does not choose images for photo album within 3 weeks of the gallery being sent, the photographer will chose for them.

  22. In the event that there is bad weather on your event day no refund or credit is given. It is recommended that the client has an alternate location in the event that the weather is not appropriate to take outdoor photos and videos.

  23. Please examine carefully all video/photo products shortly after pick up. Notify us within 7 days should there be any need for revisions or corrections. 

  24. Average length of full length video is 1 hour, average length of high light view is 3 - 5 minutes.
