Welcome to Rivendale Ranch (the “Camp”). The owners of the Camp (the “Owners”) make the Camp available from time to time for use by friends, church groups, members of the community, and others. The Owners make the Camp available for this purpose as a service to the users of the Camp and to our community. We hope you will enjoy your visit, and that you will be mindful of your own safety and the safety of others enjoying the Camp, please review this Liability Waiver and Wildfire Risk Acknowledgement and sign them below.
LIABILITY WAIVER
I would like to participate in activities at the Camp, and I understand that I am required to sign this Liability Waiver before I can participate in activities at the Camp or otherwise use the Camp. I also understand that my children (if any) will not be permitted to participate in activities at the Camp unless their names are listed below.
I UNDERSTAND THAT THERE ARE MANY RISKS ASSOCIATED WITH USE OF THE CAMP AND PARTICIPATION IN ACTIVITIES AT THE CAMP, AND THAT MANY OF THE ACTIVITIES I CHOOSE TO PARTICIPATE IN MAY BE INHERENTLY DANGEROUS AND POTENTIALLY CAUSE SEVERE INJURY OR DEATH. MY VOLUNTARY PARTICIPATION IN THESE ACTIVITIES AND THE USE OF THE CAMP IS WITH MY KNOWLEDGE OF THE RISKS INVOLVED. I AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY AND CAMP DAMAGE.
As consideration for being permitted to access and use the Camp, I, on behalf of myself and the minors (whom I am required to identify below), to the fullest extent permitted by applicable law, hereby expressly waive and release any and all claims, now known or hereafter known, against the Owners, and its officers, directors, employees, agents, affiliates, owners, successors, and assigns (collectively, “Releasees”), arising out of or attributable to participation in, attendance at, travel to, and/or use of the Camp and any activities occurring therefrom, including, without limitation, injury, death, or property damage, whether arising out of the negligence of the Owners or otherwise. I, on behalf of myself and the minors, covenant that we will not make or bring any such claim against the Owners or any other Releasee, and forever release and discharge the Owners and all other Releasees from liability under such claims. Further, to the fullest extent permitted by applicable law, I, on behalf of myself and the minors, shall defend, indemnify, and hold harmless the Owners against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees, fees and the costs of enforcing any right to indemnification under this Liabilty Waiver, and the cost of pursuing any insurance providers, arising out or resulting from any claim of a third party related to the Camp.
I hereby consent to and approve in all respects the terms and conditions of this Liabilty Waiver on behalf of the minors listed below and agree that both the minors and I shall be bound by all of its terms and conditions. I understand that this Liability Waiver is not revocable or waivable. This Liability Waiver constitutes the sole and entire agreement of the Owners, me, and the minors with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreement, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Liability Waiver is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Liability Waiver or invalidate or render unenforceable such term or provision in any other jurisdiction. This Liability Waiver is binding on and shall inure to the benefit of the Owners, me, and minors, and their respective successors and assigns. All matters arising out of or relating to this Liability Waiver shall be governed by and construed in accordance with the internal laws of the State of Arizona without giving effect to any choice or conflict of law provision or rule (whether of the State of Arizona or any other jurisdiction). Any claim or cause of action arising under this Liability Waiver may be brought only in the federal and state courts located in Maricopa County, Arizona and I hereby consent to the exclusive jurisdiction of such courts.
I HAVE CAREFULLY READ THIS LIABILITY WAIVER AND UNDERSTAND ITS PROVISIONS. I AM AWARE THAT THIS IS A WAIVER AND RELEASE OF LIABILITY AND A PROMISE NOT TO SUE.
WILDFIRE RISK ACKNOWLEDGEMENT
As an additional stipulation for using the Camp, we ask that you acknowledge the extreme risk that wildfire poses to the property and abide by the following rules:
- Campfires are only permitted in the designated fire ring during certain seasons and conditions. Refer to 311info.net for latest fire restrictions.
- Smoking is only allowed at the campfire pit or on the deck outside the main house.
- No fireworks are allowed on the property.
- All vehicles must remain on the property on the main roads only, please keep speed under 15 mph.
- Only licensed drivers for golf carts and 21 years and older to drive UTVs.
- No reckless driving, joyriding, donuts or high speeds. Vehicles are for transportation only.
I HAVE CAREFULLY READ THIS ACKNOWLEDGEMENT AND UNDERSTAND ITS PROVISIONS. I AM AWARE THAT I AM REQUIRED TO FOLLOW THE ABOVE RULES AND UNDERSTAND THAT I AM FINANCIALLY LIABLE FOR THE COST OF FIGHTING ANY HUMAN-CAUSED FIRES AS A RESULT OF MY ACTIONS.
