Waiver

WARNING -UNDER KENTUCKY LAW, A FARM ANIMAL ACTIVITY SPONSOR, FARM ANIMAL PROFESSIONAL, OR OTHER PERSON DOES NOT HAVE THE DUTY TO ELIMINATE ALL RISKS OF INJURY OF PARTICIPATION IN FARM ANIMAL ACTIVITIES THERE ARE INHERENT RISKS OR INJURY THAT YOU VOLUNTARILY ACCEPT IF YOU PARTICIPATE IN FARM ANIMAL ACTIVITIES. Failure to comply with the requirements concerning warning signs and notices provided under KRS 247.401 to 247.4029 shall prevent a farm animal activity sponsor or farm animal professional from invoking the provisions of KRS 247.401 to 247.4029. Nothing in KRS 247.401 to 247.4029 shall create a duty for a farm animal activity sponsor, farm animal professional, or other person to give a warning to a participant engaged in a farm animal activity with his own farm animal, or to a participant whom the farm animal activity sponsor, farm animal professional, or other person knows to possess reasonable knowledge of or experience with the inherent risk of farm animal activities, or who has represented to the farm animal activity sponsor, farm animal professional, or other person that he possesses reasonable knowledge or experience with the inherent risks of farm animal activities. Each of the terms and conditions of the previous contract are hereby reaffirmed and understood to be valid and binding. Kentucky law shall govern this amendment.

I agree to the following Agreement, as a condition to receiving riding instruction on the premises of Red Fern Riding Center LLC, 5063 Aiken Road Simpsonville, KY 40067, and Justine Saudan, Owner Operator of Red Fern Riding Center.

All parts of this Agreement shall apply to Justine Saudan, Red Fern Riding Center LLC the Contracting Party(s), as well as the children/legal wards of the Contracting Party(s). We will hereafter collectively call ourselves “the Parties” throughout this agreement.

This Agreement is binding when I am permitted to receive riding instruction by Red Fern Riding Center LLC. Kentucky law governs this agreement.

The Parties understand that anyone riding or near a horse can suffer bodily and other injuries. Among other things, horses are unpredictable by nature. For example, when frightened, angry or under stress, a horse’s natural instincts are to jump forward or sideways, run away from danger by trotting or galloping. Horses are also known to kick, buck, rear up and bite. I know that a horse can do any of these things without warning or history or these behaviors. 

The Parties understand that horses are powerful and potentially dangerous.

The Parties understand that riding lessons, by nature, can impose above normal stresses upon the horse and myself. I understand these risks and dangers, and voluntarily assume them.

The Parties understand that they are responsible for their own safety on or about the Stable’s property, and the Parties agree to wear an ASTM/SEI approved helmet when riding horse(s) on the Stable’s property.

Liability Release: The Parties assume full responsibility for any and all bodily injuries or damages which the Parties may sustain before, during, or after their riding lesson while on or near the property of Red Fern Riding Center LLC. By the term “damages” the Parties mean medical expenses, expenses incurred because of bodily injury or mental or emotional trauma, property damage, and/or personal property damages. I, for my heirs, administrators, personal representatives or assigns, release and discharge Justine Saudan, as well as Red Fern Riding Center LLC. , and their respective employees, agents, officers, directors, subsidiaries, heirs, executors, administrators, insurers, representatives, successors and assigns of and from all claims, demands, actions, omissions, rights of action or causes of action (present and future), liabilities or obligations, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of my bodily injury or damage that may be sustained before, during or after my riding lesson or property damage.

The Parties agree that, should medical insurance be required, The Contractor and/or their accident/ medical insurance company SHALL PAY for all incurred medical expenses.

The Parties authorize Justine Saudan or an authorized employee to seek and authorize treatment to be given to the Contracting Parity or Parties child(ren). If the party is unable to authorize medical treatment they will have it billed to their accident/medical insurance company or the Contracting Party and SHALL PAY out of pocket for all incurred medical and personal expenses incurred from that emergency.

The Contracting Party represents that they are at or over 18 years of age, of sound mind, and not suffering from shock or under the influence of alcohol, drugs, or intoxicant.

The Parties understand that the only area maintained for riding is the indoor and outdoor ARENA any horse should be walked to and from both. No other area (trails or any area outside of the barn) is safe from Visible Hazards (mole holes, woodchucks, Sinkholes etc.). I also understand if I don’t have my own tack/saddle, and I depend on the barn's equipment, that I should inspect said equipment for safety before use. Knowing full well barn tack is used by many, and impossible to check after every use.

This document is meant to be a full and complete release from any and all liability that may arise from participating in the above described activities. I represent that: I am at or over 18 years of age, of sound mind, and not suffering from shock or under the influence of alcohol, drugs, or intoxicated. This release is given freely and voluntarily by the participant and is meant to remain in existence throughout the duration of any and all equine activities.

The Parties hereto acknowledge that they have read this Agreement, understand its contents, they are signing it as their free act and deed without any coercion by anyone, and they agree to be fully bound by its terms.
