PGA Waiver

WAIVER OF LIABILITY FOR PERSONAL INJURIES AND INDEMNITY AGREEMENT I, _____________________________(Participant / Guardian of Participant), understand that participation in any activities offered at Precision Gymnastics Academy (“PGA”), including but not limited to gymnastics, general exercise instruction, and dance, involve risks of personal injury, including but not limited to paralysis and death (the “Risks”). In exchange for my participation in any activities offered at PGA, I assume the Risks, whether caused by PGA’s owners, landlords, subleases, employees, independent contractors, volunteers, activity participants, and / or spectators while on PGA’s premises, and regardless of whether the Risks arise from the intentional, reckless, or negligent conduct of any of these people. I further waive any right to make claims or file lawsuits against PGA’s owners, landlords, subleasees, employees, independent contractors, volunteers, and insurers (the “Releasees”) for damages resulting from the Risks arising from my participation in any activity while on PGA’s premises. I further agree that I will indemnify, hold harmless, and defend the Releasees to the extent anyone makes any claim or files any lawsuit against any of the Releasees arising from the Risks.
