Waiver Form - ENCO Soccer Club/Pipech Elite Preseason Technical Training Soccer Camp

Waiver of Liability, Release for Group Soccer Training, titled Pipech Elite Soccer Training, with Robert Pipech  

June 2021 through September 2021 

Assumption of Risk & Indemnity Agreement 

1) For and in consideration of participant’s registration with Robert Pipech (registration occurs by completing this document), being allowed to participate in this soccer training, the parent(s) or legal guardian(s) of participants relinquish any and all liability for and cause of action for personal injury, property damage or wrongful death occurring to participant arising out of participation in individual training with Robert Pipech and/or activities incidental thereto, whenever or however they occur and for such period said activities may continue, and by this agreement any such claims, rights, and causes of action that participant may have are hereby relinquished and the participant (or parent(s)/guardian(s)) does(do) so on behalf of my/our and participant’s heirs, executors, administrators and assigns. 

2) Participant and/or participant’s parent(s)/guardian(s) acknowledge, understand and assume all risks inherent in sport activities and this individual training, and understand that said sport activities involve risks to participant’s person including bodily injury, partial or total disability, paralysis, and death, and damages which may arise from and that I/we have full knowledge of said risks. These risks and dangers may be caused by the negligence of the participant or the negligence of others, including the “releasees” identified below. It is further acknowledged that there may be risks and dangers not known to us or are not reasonably foreseeable at this time. I/We agree to abide by and be bound under the rules of play. 

3) Participant and/or participant’s parent(s)/guardian(s) acknowledge, understand and assume the risks, if any, arising from the conditions and use of the fields and related premises and acknowledges and understands that included within the scope of this waiver and release is any cause of action, arising from the performance, or failure to perform maintenance, inspection, supervision or control of said areas and for the failure to warn of dangerous conditions existing at said outdoor fields (FoxRun Fields, Forks Township, or any other used field), for negligent selection of certain releasees, or negligent supervision or instruction by releasees. 

4) Participant and/or participant’s parent(s)/guardian(s) acknowledge, understand and assume the risks, if any, arising from the conditions and use of indoor sporting fields and related premises and acknowledges and understands that included within the scope of this waiver and release is any cause of action, arising from the performance, or failure to perform maintenance, inspection, supervision or control of said areas and for the failure to warn of dangerous conditions existing at said indoor fields, for negligent selection of certain releasees, or negligent supervision or instruction by releasees. 

5) Participant or participant’s parent(s)/guardian(s) agree if any claim for participant’s personal injury or wrongful death is commenced against releasees, he/she shall defend, indemnify and save harmless releasees from any and all claims or causes of action by whomever or wherever made or presented for participant’s personal injuries, property damage or wrongful death. 

6) It is the purpose of this agreement to exempt, waive and relieve releasees from liability for personal injury, property damage, and wrongful death caused by negligence, including the negligence, if any, of releases. ‘Releasees’ include Robert Pipech, or any other individual approved by Robert Pipech who assists in conducting the small group training, other participants, coaches, officials, sponsors, advertisers, owners and operators of the premises used to conduct my event and each of them, their officers, directors, agents and employees. 

7) I grant to Robert Pipech, its agents, successors and assigns, the right to take and use photographs of my child, named below, in connection with this soccer training. I authorize Robert Pipech, its assigns and transferees to copyright, use and publish the same in print and/or electronically. 

8) I agree that Robert Pipech, and other media outlets, may use such photographs with or without my child’s name and for any lawful purpose, including but not limited to, for example, such purposes as publicity, e­-newsletters, printed literature, advertising, and Web content. I hereby release Robert Pipech from any claim for compensation or remuneration for said photographs. 

9) This permission is absolute, final and irrevocable and shall be binding upon the Parent/Guardian, child and their collective successors, legal representatives, heirs and assigns. This release shall be interpreted and governed in accordance with the laws of the Commonwealth of Pennsylvania. 

10) At the conclusion of the training time for each session (6:15 PM, 7:30 PM or any other time announced for training to conclude by a staff member or Robert Pipech), anything that occurs at this point is the sole responsibility of the child and the child’s family. Participants, parents/guardians, and families must leave the premise of training at the conclusion of training.   

11)  Every effort will be made to have every session of the training.  The facility is owned by a business that has rented out space to Robert Pipech (releasee).  If the facility or fields are closed for any reason, such as a hazard, inclement weather, or otherwise, this is out of the organizer’s control. Other reasons a session could be cancelled include emergencies and poor road conditions due to inclement weather. By signing, I hereby agree to not make any claims as a result of cancelled sessions. 

12) Participant and/or participant’s parent(s)/guardian(s) acknowledge that they have been provided and have read the above paragraphs and have not relied upon any representations of releasees, that they are fully advised of the potential dangers of sporting activities and this individual soccer training and understand these waivers and releases are necessary to allow sporting facilities and this soccer training to exist in their present form. Please read this release and waiver carefully and contact Robert Pipech if you have any questions.

June 2021 to September 2021 Assumption of Risk & Indemnity Agreement 

By signing below, I, parent/legal guardian of _______________ (entered below) agree that I have read the conditions of this document entirely, understand them, and agree and accept the terms. Again, as stated above, I release Robert Pipech, his associates, Northampton County, Forks Township,  ENCO soccer club, NSCAA, and employees working for Robert Pipech for the soccer training from any or all liability of any kind, financially or otherwise, as a result of the soccer training being provided to my child as stated above. 

I hereby certify that the applicant (participant) is in good physical condition to participate in the 2021 ENCO Soccer Club/Pipech Elite Technical Training Soccer Camp. If medical assistance is required for illness or injury while attending the camp, I give permission for such care and I certify I have medical insurance, and that the applicant is covered by our family medical insurance. Players who are not covered through their parents or caregiver’s insurance CANNOT participate.  Robert Pipech, associates, Northampton County, Plainfield Township, or any party associated with the camp are all not responsible legally or financially in any manner, and will not provide any payment or have any responsibility for any medical, dental, hospital, transportation, or laboratory fees due to injury incurred while participating in the 2021 Pipech Elite Summer Goalkeeper Training.  I hereby release Robert Pipech and his staff of any and all liability from any type of injury as a result of this training.  

RELEASE OF LIABILITY FOR MINOR PARTICIPANTS 

READ BEFORE SIGNING

IN CONSIDERATION OF my child/ward being allowed participate in any way in the Pipech Elite Soccer Training or training with Robert Pipech and his associates in related events and activities, the undersigned acknowledges, appreciates, and agrees that:

The risks of injury and illness (ex: communicable diseases such as MRSA, influenza, and COVID-19) to my child from the activities involved in these programs are significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist; and,

1. FOR MYSELF, SPOUSE, AND CHILD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my child’s participation; and,

2. I willingly agree to comply with the program’s stated and customary terms and conditions for participation. If I observe any unusual significant concern in my child’s readiness for participation and/or in the program itself, I will remove my child from the participation or let a staff member know to remove them from participation 

3. I myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Pipech Elite Soccer Training or training with Robert Pipech and his associates in related events and activities ; its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property incident to my child’s involvement or participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

4. I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releasees from any and all liabilities incident to my involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.

5. I, the parent/guardian, assert that I have explained to my child/ward: the risks of the activity, his/her responsibilities for adhering to the rules and regulations, and that my child/ward understands this agreement.

I, FOR MYSELF, MY SPOUSE, AND CHILD/WARD, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. 

By signing below, I hereby confirm that I have read all pages of this agreement, understand them in their entirety, and agree by the terms set forth in this agreement. There are no refunds provided.
