Goalkeeping Training Contract Agreement between Dominate the 18 Goalkeeper and Soccer Training and the Parkland Area Soccer Club - Spring 2024
This agreement is between Dominate the 18 Goalkeeper and Soccer Training LLC/and his associates (hereinafter referred to as “Goalkeeping Coach”) and the Parkland Area Soccer Club organization (hereinafter referred to as the “Club”). This contract is in full effect upon being signed by all parties.
Section 1: This agreement is for 12 sessions, with session length being 1-hr in length, with 2 sessions per evening at a facility/venue that the Club has approval from property owners and/or businesses to use. There is a maximum of 8 Goalkeepers per session to ensure each goalkeeper gets live situations in the goal, as well as proper individual attention, needed to improve as a goalkeeper.
Section 2: The terms of this contract is for $170 per 1-hr session, with two sessions each night, for a total of $2,040. Full Payment is due before the first agreed upon training date. The club can also pay in two installments, should they choose to do so. Any payments should be given to Bob Pipech only, and should not be given to any trainers associated with Bob Pipech and Dominate the 18 Goalkeeper and Soccer Training. Please make out the check to DOMINATE the 18 Goalkeeper and Soccer Training. If payments are made in two installments, $1,020 is due before the first session, and $1,020 is due before the 5th session. If for any reason the Goalkeeping Coach is unable to fulfill the contract, the amount per session not completed of $170 per 1-hr session will be refunded. There are no refunds for any other reason.
Section 3: The Parkland Area Soccer Club and the parents and families of the participants hereby release the Goalkeeping Coach of any liability of any kind, whether financial or otherwise, as a result of the training the Goalkeeping Coach provides. While the Goalkeeping Coach will use his or her best judgment and act in the best interest of the safety of all participants, soccer is a sport where serious injury and death are possible. The club releases the Goalkeeping Coach of any and all liability of any kind as a result of the training.
Section 4: While conducting this training, the Goalkeeping Coach is/are serving as an agent for the club. Therefore, any injuries sustained by the participants (minors) are covered by the club’s insurance policy. The Goalkeeping coach is/are in no way responsible or liable in any way for any injuries of any kind sustained. As club representatives signing below, you certify that the Parkland Area Soccer Club has insurance for its players and/or insurance through EPYSA, and that all training activities provided by the Goalkeeping Coach are covered by the club insurance.
Section 5: The Goalkeeping Coach may take videos or pictures of the players during training. These pictures will be used for informative and promotional use only. These players are considered minors under the age of 18. By signing below, the club gives consent for such media forms to be taken, and has informed parents of this fact and all elements of this section. The club will let the Goalkeeping Coach know immediately of any parent or caregiver who does not consent for their child’s picture or video of their child participating in the training to be taken during the training sessions.
Section 6: The Goalkeeping Coach agrees to attend all scheduled sessions. In the event of an emergency, the Goalkeeping Coach will give the club 24-hours notice to reschedule. If the club needs to cancel a session for any reason, the club agrees to also provide 24-hours notice. If there is a cancellation due to weather, the club will do their best to inform the coach 2-hours prior to the session’s start or as soon as possible. Both parties will work in good faith to reschedule sessions promptly. The Goalkeeping Coach desires to hold all contracted sessions. If the club refuses to reschedule canceled sessions, there are no refunds for unused sessions to the Goalkeeping Coach. There are no refunds for any other reason.
Section 7: The Goalkeeping Coach is not responsible in any way for any damage to the field or facility as a result of training, but will use their best judgment to protect fields from excessive wear in spots when possible. The club confirms that full written and formal permission has been obtained by the business or facility owners to use the field or facilities. ------------------------------------------------------------------------------------------------------------------------------------------
Section 8: Full Release of all liability: By signing below, the club as undersigned is acknowledging and signing on behalf of the parents and guardians of all participants and has informed all parents and guardians of the participants of such prior to the start of the training.
This Section (Page 2 and Page 3) is on behalf of all parents and guardians of the participants. While the parents of each participant do not need to sign, the club acknowledges that they have provided this section to parents. By club representatives signing below (Page 3), they confirm that this information has been provided to parents, and confirm that all parents, players, and the club agree to the terms and conditions.
The undersigned acknowledges that the risk of injury to myself or my child from the activities involved in these programs is significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist, and I agree to the following: Assumption of Risk : FOR MYSELF, SPOUSE, AND CHILD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my child’s participation; and I willingly agree to comply with the program’s stated and customary terms and conditions for participation. If I observe any unusual significant concern in my child’s readiness for participation and/or in the program itself, I will remove my child from participation and bring such attention to the Goalkeeping coach or club representative of the Parkland Area Soccer Club.
Medical Release -I assume all risks and hazards incidental to such participation or my child’s participation in Goalkeeping Training with Dominate the 18 Soccer and activities and consent for my child and myself to receive first-aid and/or emergency care by a qualified Emergency Medical Technician (Ambulance or Emergency Services) or physician or other person qualified to render medical assistance in the event that I or my child suffer an injury during sanctioned training and activities. I agree to have any and all medication (prescription and non-prescription) for myself or my child and shall be solely responsible for dispensing any such medication to my child.
Media Release –The club and parents understand that there may be media and promotional coverage of Goalkeeper Training with DOMINATE the 18 Soccer and activities and I give my consent to publish my name and picture or my child’s name and picture for any and all such purposes including social media. I hereby grant Dominate the 18 Soccer, its affiliates, advertising and promotional agencies, and their agents, the irrevocable, unrestricted right and license to use, publish, display and distribute materials bearing my (or my child’s) name, voice, likeness or any other identifiable representation of me and my family members. I hereby release and forever discharge Dominate the 18 Soccer, its owner, and contractors from any and all liability and damages relating to my (or my child’s) name, voice, likeness or any identifiable representation of me or my child. I hereby waive any right I may have to inspect or approve the finished material or any part of element thereof that incorporates my (or my child’s) name, voice, likeness or any other identifiable representation of my family and me. I have agreed to the above in consideration of the opportunity given to me (or my child) by Dominate the 18 Soccer to appear in these materials.
Full Release: I myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Dominate the 18 Soccer, its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property incident to my child's involvement or participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releasees from any and all liabilities incident to my involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
