NUWAVE JIU-JITSUWAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISKIMPORTANT: PLEASE READ CAREFULLY BEFORE SIGNING
This document affects your legal rights. By signing this Waiver, Release of Liability, and Assumption of Risk Agreement ("Agreement"), you are waiving certain legal rights, including the right to sue for injuries sustained while participating in Brazilian Jiu-Jitsu (BJJ) activities at NuWave Jiu-Jitsu.
1. NATURE OF BRAZILIAN JIU-JITSUI understand and acknowledge that Brazilian Jiu-Jitsu is a FULL-CONTACT COMBAT SPORT AND MARTIAL ART that involves:• Direct physical contact with training partners and instructors• Grappling, throwing, takedowns, and ground fighting techniques• Joint manipulation, including arm locks, leg locks, and wrist locks• Choking and strangulation techniques (blood chokes and air chokes)• Submission holds that may cause pain, injury, or loss of consciousness• Intense physical exertion and cardiovascular stress
2. ASSUMPTION OF RISKI FULLY UNDERSTAND AND ACKNOWLEDGE THAT INJURIES CAN AND DO OCCUR IN BRAZILIAN JIU-JITSU. I voluntarily assume all risks associated with participation, including but not limited to:• Sprains, strains, muscle tears, and soft tissue injuries• Broken bones, fractures, and dislocations• Cuts, bruises, abrasions, and contusions• Concussions and head injuries• Spinal injuries, including paralysis• Loss of consciousness from chokes or strangulation• Skin infections (ringworm, staph, impetigo, herpes simplex)• Cardiovascular events (heart attack, stroke)• Permanent disability or disfigurement• DeathI understand these risks exist regardless of the precautions taken by NuWave Jiu-Jitsu, its instructors, staff, or training partners.
3. RELEASE OF LIABILITYIn consideration of being permitted to participate in BJJ training, classes, seminars, open mats, competitions, or any other activities at or organized by NuWave Jiu-Jitsu, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE NuWave Jiu-Jitsu, its owners, officers, directors, employees, instructors, coaches, volunteers, agents, affiliates, and all other participants (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such activities, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.
4. MEDICAL ACKNOWLEDGMENTI certify that:• I am in good physical health and have no medical conditions that would prevent safe participation in BJJ• I have disclosed all relevant medical conditions, injuries, or limitations to NuWave Jiu-Jitsu staff• I have consulted with a physician if I have any doubts about my ability to participate safely• I authorize NuWave Jiu-Jitsu to seek emergency medical treatment on my behalf if I am unable to do so
5. RULES AND CONDUCTI agree to:• Follow all rules, policies, and instructions provided by NuWave Jiu-Jitsu and its instructors• "Tap out" when caught in a submission to avoid injury• Immediately release any submission hold when my partner taps• Train with appropriate control and respect for my training partners• Maintain proper hygiene and wear clean training attire• Not train while under the influence of drugs or alcohol• Report any injuries, symptoms of illness, or unsafe conditions immediately
6. PHOTO AND VIDEO RELEASEI grant NuWave Jiu-Jitsu permission to photograph and/or video record me during training and events, and to use such images for promotional, educational, or commercial purposes without compensation.
7. INDEMNIFICATIONI agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any claims, suits, losses, damages, costs, and expenses, including reasonable attorney's fees, arising from my participation in BJJ activities or any breach of this Agreement.
8. BINDING AGREEMENTI acknowledge and agree that:• This Agreement shall be binding upon me, my heirs, executors, administrators, and assigns• This Agreement shall remain in effect for as long as I participate at NuWave Jiu-Jitsu• If any provision is found unenforceable, the remaining provisions shall remain in full force• I have read this Agreement in its entirety and fully understand its contents
9. MINORS (PARTICIPANTS UNDER 18)If the participant is under 18 years of age, I, as the parent or legal guardian, hereby consent to their participation and agree to all terms of this Agreement on their behalf. I accept full responsibility for any injury or damage that may occur and agree to indemnify and hold harmless the Released Parties.
BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ THIS ENTIRE AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS INCLUDING MY RIGHT TO SUE, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
