Little Land Play & Grow Liability Waiver
A completed waiver is required to participate at Little Land Play & Grow
WAIVER OF LIABILITY/ASSUMPTION OF RISK
In order to be allowed to enter into the play area and/or participate in any party and/or program at the undersigned, on his or her own behalf, and/or on behalf of the participant(s) identified below, acknowledges, appreciates and agrees to the following AGREEMENT
A. RISK INHERENT IN USING LITTLE LAND PLAY & GROW
The play equipment at Little Land Play & Grow can be dangerous. I understand that there is a possibility of serious injury to the person or child. I am aware of the hazards, danger and risks of injury that can result of participation at Little Land Play & Grow, including those that may arise out of the negligence or other participants. These risks include without limitation, scrapes, bruises, cuts, sprains and even more serious injuries including disability and death. Any of the equipment could fail unexpectedly, or other users may participate in an out-of-control manner that exceeds the manufacturer’s recommendations. Using toddler riding toys may result in falls, pinched fingers or toes, collisions with other users or persons present.
I understand the operational rules listed below and I understand that it is my responsibility to ensure that I, and my children understand the rules. Although there will be staff members to monitor children playing, it is my responsibility to monitor all the children listed below. I will bring any observation of the rules being broken to the attention of the Little Land Play & Grow staff member.
B. LITTLE LAND PLAY & GROW RULES
I agree to observe these rules when using play equipment at LITTLE LAND PLAY & GROW:
1. Adult supervision is always required during duration of visit. This includes during restroom trips, while playing in different areas or using play equipment.
2. Ensure children understand and follow the rules and policies posted throughout the facility.
3. Socks are REQUIRED at all times while inside the play area.
4. NO FOOD,DRINKS, GUM, SILLY STRING OR CONFETTI is allowed in the play area.
5. All shoes and sharp objects WILL be removed prior to entrance to play area.
6. NO somersaults, wrestling, flips, rough play in the facility. If child is seeing abusing these rules your child will be asked to correct the behavior by Little Land Staff. If child refuses or ignores the first warning your child will be asked to be removed from premises. Little Land reserves the right to deny access to its facilities, either permanently or for a specified period of time, if you and your child fail to follow these rules or instructions from Little Land staff, or for any reason not prohibited by law.
C. RELEASE, DISCHARGE & AGREEMENT NOT TO SUE
I, for myself and any minor participant child and our respective heirs, personal representatives and assigns, do hereby release, discharge and agree not to sue Little Land Play & Grow or its managers, members, employees and/or other agents, for any sickness, injury to or death of any participant arising, directly or indirectly, from participation in the Activities. This release, discharge and covenant not to sue shall relate to any and all claims or legal rights now existing or arising in the future, including claims and legal rights arising out of any negligence of Little Land Play & Grow and/or its managers, members, employees and/or other agents and any other breach of a legal duty arising out of common law, statute, contract or otherwise.
The undersigned agrees to pay for all damages to the facilities of Little Land Play & Grow caused by them or their family's negligent, reckless, or willful actions.
The undersigned agrees to abide with rules and conditions of participation and/ or attendance, posted at or explained by an employee at Little Land Play & Grow. If the undersigned experiences any significant hazard or injury during such participation, the undersigned will promptly inform an employee of the company facility which they are currently attending.
D. SECURITY CAMERAS
I understand that security cameras installed around and within Little Land Play & Grow facility are for the safety of all participants and may be referenced should any incidents or injury occur.
E. AGREEMENT TO PERMIT RECORDING AND USE OF IMAGES
I Grant Little Land Play & Grow permission to use any photographs, video, or sound bites obtained of me or any minor Participant child at Litte Land Play & Grow facility for any legal use including but not limited to publicity, advertisement and web content. I understand that no royalty or other compensation shall be payable to me or the minor Participant by reason of such use.
F. OTHER TERMS
1. This agreement is binding upon you and your assigns, successors, heirs, representatives and executors.
2. Terms in this agreement shall not be modified or waived by any action or verbal communication and may be modified or waived only in a writing signed by an authorized representative of LITTLE LAND.
In addition to any rules posted on premises, rules that also MUST be followed are the following:
- We are a sock only facility and socks are required for all guests. (Grippy socks are recommended for the kids)
- We are a parent/guardian supervised facility. Parents/Guardian must remain on the premises at all times.
- A signed waiver and acknowledgement of rules is required for every child and adult that enters the facility.
- Admission will not be granted for sick children, for the safety of and well-being of others. We have the right to refuse service.
- Children must always be accompanied into the restroom by an adult.
- No rough play, pushing or throwing.
- Strollers are not allowed in the play areas.
- Adult are not permitted on the play structures.
- We are not responsible for lost or stolen property.
- Patrons not abiding by the rules will be asked to leave and no refund will be given.
I hereby release and agree to hold Little Land Play & Grow harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may
be caused by any act, or failure to act , or that may otherwise arise
in any way in connection with any services received from Little Land Play & Grow. I understand
that this release Little Land Play & Grow from any
liability or claim that my heirs, any personal representatives, or I may have against the salon with respect to any bodily injury, illness, death, medical treatment,
or property damage that may arise from, or in connection to, any
services received from Little Land Play & Grow. This liability
waiver and release extends to the playground together with all owners,
partners, and employees.
I hereby certify that; I have carefully read the foregoing covenant not to sue and acknowledge that I understand and agree to all of the above terms and conditions. I am aware that by signing this agreement, I assume all risks and waive and release all substantial rights that I may have and possess.
By signing below, I represent that I am the parent or legal guardian of the child(ren) named below, or I have obtained permission from the parent/legal guardian of such child(ren) to execute this agreement on their behalf. I agree that the child(ren) named below and I shall comply with all stated and customary terms, posted safety signs, rules and verbal instructions as conditions for participation at Little Land Play & Grow understand that this is a permanent waiver to be kept on file by Little Land Play & Grow for today's visit/party and all future visits.
I hereby release, indemnify, and agree to hold Little Land Play & Grow harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act, or that may otherwise arise in any way in connection any services received from Little Land Play & Grow.
