Outfitter Agreement

Higher Ground USA, Inc. (“Higher Ground”) is a non-commercial, not for profit activity provider. By signing below, I, the Outfitter agree:

Indemnification: Outfitter agrees to indemnify, defend, and hold harmless the Higher Ground and its affiliates, successors, predecessors, parents, subsidiaries, owners, representatives, administrators, directors, officers, agents, coaches, employees, contractors, assigns, and volunteers from and against any liability or damage of any kind and from any suits, claims, or demands, including legal fees and expenses whether or not in litigation, arising out of, or related to, Outfitter’s gear, equipment, or any other product provided to Higher Ground and used as part of Higher Ground’s events or activities.  

Photo and Media Release: I hereby grant to Higher Ground the right and permission to photograph, film, videotape, record, and/or portray my name, likeness, image, voice, appearance and/or activities in connection with my participation in Higher Ground’s programs, events and activities. Higher Ground may use the materials for any lawful purpose, including but not limited to publicity, marketing, advertising, promotion, illustration, trade and editorial uses, without further compensation, consideration, notice or permission to me or any third party.

General Provisions: This Agreement is governed by the laws of the State of Idaho, without giving effect to any choice of law provision or rule. Any action shall be filed only in Blaine County Idaho and I consent to the personal jurisdiction of such courts for the purposes of any such action. This Agreement is intended to be as broad and inclusive as permitted by Idaho state law, and if any clause or provision of this Agreement is held invalid the enforceability of the remaining provisions of this Agreement shall not be affected.

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I SIGN IT OF MY OWN FREE WILL.
