This agreement is by and between POWER P BOUNCE LLC, as well as the individual whose name is signed and printed below (herein referred to as the participant) in reference to participating in any fitness class or event with Power P Bounce & Co. contracted instructors or board approved certified fitness instructor substitutes (herein referred to as CLASSES) at ANY LOCATION OR FACILITY.
I hereby agree to the following:
1. I am participating in CLASSES, offered by POWER P BOUNCE & Co. I recognize that CLASSES require physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.
2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in CLASSES. I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in CLASSES.
3. In consideration of being permitted to participate in CLASSES, I agree to assume full responsibility for any risk, injuries or damages, known or unknown, which I might incur as a result of participating in the program.
4. In further consideration of being permitted to participate in CLASSES, I knowingly, voluntarily, and expressly waive any claim I may have against POWER P BOUNCE LLC and all HELPERS OR INSTRUCTOR(S) for damages, and injury, including death that I may sustain as a result of participating in CLASSES.
5. I, my heirs, or legal representative forever release, waive, discharge and covenant not to sue Power P Bounce LLC, POWER P BOUNCE & Co., fitness instructor(s), or HELPER(S) for any injury or death caused by my voluntary participation in the CLASSES.
6. I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above. This agreement remains in effect for as long as I participate in CLASSES.
POWER P BOUNCE & Co. may on occasion take photographs and/or video of its members or program participants for use in print materials, marketing, and public relations or by electronic methods. Use of photograph(s) and/or video will result in NO compensation from POWER P BOUNCE & Co. to the member or participants.
