Adult/Family Waiver of Liability (DL/OV)

As a condition for your participation in the Outdoor Voices Event (the “Event”) produced by Outdoor Voices Inc. (“OV”) and by signing this Content Release, you hereby agree and consent to the following:
You understand the Event, participants in the Event, and your likeness will be recorded in video or in still and the sound of your voice will be recorded, and you hereby consent to such recording.  
 
You grant OV and its affiliates and representatives permission to use interview(s), photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction (the “Content”) for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any and all other format, venues, or distribution channel now known or later discovered, in all languages, markets, and geographies, irrevocably and in perpetuity.  You understand the Content may be edited or modified and you waive any right to inspect or approve the Content or materials produced therefrom.  You understand the Content is the property of OV and OV may, without limitation, exercise all ownership rights including copyrights related to such recordings.
 
You waive all rights you may have to any claims for payment or royalties in connection with any use of the Content, regardless of the purpose or sponsoring of such use irrespective of whether the usage is of monetary benefit to OV.  In no event will you have the right to seek or obtain injunctive or other equitable relief in connection with the Content or the development, production, distribution, or exploitation of the Content.
 
You hold harmless and release OV, its officers, affiliates, and employees, and each and all persons involved in the production or recording of the Event or use of the Content from all liability, petitions, and causes of action in connection with the Event or usage of the Content which you, you heirs, representative, executors, administrators, or any other persons may make while acting on your behalf or on behalf of your estate.
You agree to comply with all rules, restrictions, and instructions set forth by OV or its representatives, including OV’s Terms of Use and Privacy Policy.

As a condition for your participation in the Outdoor Voices Event (the “Event”) produced by Outdoor Voices Inc. (“OV”) and by signing this COVID Release, you hereby agree and consent to the following:
While participating in the Event, you agree to comply with all COVID-related procedures that include mask-wearing, following safe social distancing, as well as restrictions on certain activities that carry higher COVID-related risk, in order to protect the health and safety of all attendees. However, Outdoor Voices cannot guarantee that its participants, partners, or others in attendance will not become infected with COVID-19.
 
In light of the ongoing spread of COVID-19, individuals who fall within any of the categories below should not engage in Outdoor Voices events and/or other face-to-face activities. By attending the Event, you certify that you do not fall into any of the following categories:  
1.     Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include but are not limited to fever, cough, and shortness of breath;
2.     Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that has experienced or is experiencing sustained community spread of COVID-19; or  
3.     Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.
 
You hold harmless and release OV, its officers, affiliates, and employees, and each and all persons involved in the Event from all liability, petitions, and causes of action in connection with the Event or COVID-19 which you, you heirs, representative, executors, administrators, or any other persons may make while acting on your behalf or on behalf of your estate.

IN CONSIDERATION OF the risk of injury that exists while participating in the Outdoor Vocies Event (the “Event”) produced by Outdoor Voices Inc. (“OV”); and

IN CONSIDERATION OF my desire to participate in said Event and being given the right to participate in same;

I HEREBY, for myself (hereinafter collectively, “Releasor”, “I” or “me”, which terms shall also include Releasor’s parents or guardian if Releasor is under 18 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Event; and

I HEREBY release and forever discharge OV, its affiliates, managers, staff, partners, and representatives (collectively “Releasees”) from any physical or psychological injury that I may suffer as a direct result of my participation in the aforementioned Event.

I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED EVENT AND I AM PARTICIPATING IN THE EVENT ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH PARTICIPATING IN THIS EVENT, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO: PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS’ NEGLIGENCE, CONDITIONS RELATED TO TRAVEL TO AND FROM THE EVENT, OR FROM CONDITIONS AT THE EVENT LOCATION. NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN AND UNKNOWN TO ME, OF MY PARTICIPATION IN THIS EVENT.

I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought to me or anyone on my behalf, including attorney’s fees and any related costs.

THIS WAIVER AND RELEASE OF LIABILITY SHALL REMAIN IN EFFECT FOR THE DURATION OF MY PARTICIPATION IN THE EVENT, DURING THIS INITIAL AND ALL SUBSEQUENT EVENTS OR PARTICIPATION.
