RELEASE AND WAIVER OF LIABILITY AGREEMENT

I AM AWARE THAT THESE ACTIVITIES COULD RESULT IN AN ACCIDENT, INJURY OR OTHER UNFORSEEN HAZARDS. I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES AND AGREE TO ASSUME ANY AND ALL RISKS OF BODILY INJURY OR PROPERTY DAMAGE, WHETHER THOSE RISKS ARE KNOWN OR UNKNOWN.

As consideration for being permitted by Pinnacle Adventures doing business as Camp Pinnacle in Hendersonville, NC, and any Lessee of the Camp premises (“Lessee”), to participate in activities on the Camp premises, where the Participant is subject to numerous risks, including but not limited to, environmental hazards and risks, including weather conditions, earthquakes, forest fires, landslides, flooding, steep slopes, water conditions (temperature, etc.), insects, snakes, bears or other animal encounters, falling and rolling rock, ice and timber, and hidden or unavoidable obstacles. Possible mild to serious injuries and illness include, but are not limited to, sunburn, hypothermia, frostbite, dehydration, and heatstroke.
I fully and forever release Pinnacle Adventures, its owners, directors, officers, employees, agents and affiliates, any independent operators, any other participants, and all other persons or entities associated with it, (collectively “Releasees””) from any and all actions, claims, or demands that I, my assignees, heirs, distributes, guardians, next of kin, spouse and legal representatives now have, or may have in the future, for injury, death, or property damage, related to the negligence or other acts, whether directly connected to these activities or not, and however caused, by any Release, or the condition of the premises where these activities occur, whether or not I am then participating in the activities. I also agree that I, my assignees, heirs, distributes, guardians, next of kin, spouse and legal representatives will not make a claim against, sue, or attach the property of any Release in connection with any of the matters covered by the foregoing release. If, notwithstanding the foregoing, a suit is filed, it must be filed and maintained only in a court of competent jurisdiction in Henderson County, North Carolina.
I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN ME AND CAMP PINNACLE, INC., AND SIGN IT OF MY OWN FREE WILL.
Waterfront Rules
- For safety reasons a certified lifeguard must be on duty during any activity involving swimming, rope swinging or the use of the inflatable Camp Pinnacle slide (Aqua Glide). If you choose not to contract our Lifeguards, you may use your own lifeguards. They must provide us a copy of their Lifeguards’ certification and attend a waterfront orientation from a Camp Pinnacle representative.
- The Camp Pinnacle Blob (if in water) is never available for use.
- There is no night swimming under any circumstances. All aspects of the waterfront are off limits after sunset, including all use of boats.
- When using the inflatable slide please do not wear shoes or slide headfirst. No more than two people can go down slide at once. Horseplay is never permitted, no more than 10 people may use the slide at a time.
- Wolfe Lake is shallow. For your safety, no diving is permitted including jumping board or tower.
- Only one person may use the rope swing at a time. A Certified Lifeguard must be on tower if rope swing is being used.
- In the event of a thunderstorm, or observed lightning, the waterfront will be closed for 20 minutes.
- If a lifeguard is not present, all boaters must have a buddy and wear a lifejacket. All children in boats must be under the active supervision of an adult.
- Lifejackets must be worn by everyone using the waterfront. This includes swimming and all boating activities. It is the responsibility of the leasee to enforce this policy.
- Lifeguards in swimming area are not responsible for watching boaters. Boats and standup paddle boards may never enter the swimming area. This area is marked by buoys.
- It is the responsibility of the group to return boats and paddles to original location at the end of visit.
- No glass is permitted on beach or dock areas. We have hundreds of little bare feet at the waterfront in and the last thing we want is a cut foot that can ruin a camper’s summer or school program.
I have read and understood the Camp Pinnacle Rules and Policies and The Camp Pinnacle Waterfront Rules as written above. I agree to abide by these rules, share them with my guest and ensure that my guests abide by the Camp and Waterfront rules.
