RELEASE OF LIABILITY
Purchaser assumes all responsibility for any property damage caused by Seller’s truck within the confines of the delivery site. Purchaser agrees to provide safe and suitable access to the point of delivery that has sufficient load-bearing capacity for Seller’s vehicle and that is clear of fixed objects, underground utilities, or overhanging wires. Seller’s vehicle IS NOT permitted to go off of paved surfaces or onto curbs. It puts both our drivers and trucks at risk. If so directed, Purchaser assumes all responsibility for damages that may occur as a result of Seller’s asset inside of the curb line; including towing fees. All deliveries and placement of materials are subject to delivery driver’s discretion. If driver deems placement unsuitable and owner/agent cannot be contacted, a transportation fee will apply. Local street use ordinances and permitting are the responsibility of the buyer, including, but not limited to, providing flaggers. Customer agrees to defend, indemnify and hold Britton Industries, it's shareholders, officers, directors, employees and representatives harmless from and against any and all claims, actions, judgments, demands, costs, expenses, damages, liabilities, and losses whatsoever (including reasonable attorney's fees) arising out of or related in any manner to the above referenced product- including but not limited to: it's purchase, delivery, application, or resale.
