THIS WARNING, RELEASE, INDEMNITY AND ASSUMPTION OF RISK MUST BE ACCEPTED, INITIALLED, SIGNED
AND DATED WHERE INDICATED AND PROVIDED TO THE OPERATOR AS A CONDITION OF ENTRY ONTO THE
BLACK ROCK ADVENTURE PARK AND CAMPGROUND PREMISES. PLEASE READ CAREFULLY:
RISK WARNING : Depending on the nature of the Activity, the risks include, but are not limited to, rough terrain, holes and ruts, falling objects;
collision with fixed or movable objects; flipping over; dangerous or unanticipated weather and other elements of the outdoors and natural
surroundings; exposure to potentially dangerous, hostile or aggressive wildlife, venomous or disease-carrying animals or insects, and hazardous
plant life; transmissible pathogen or communicable diseases; exposure to allergens which could cause life-threatening reactions;
equipment failures; and negligence of others.
OBVIOUS RISK NOTICE: Activities on Black Rock Adventure Park and Campground Premises are dangerous recreational activities that
involve inherent incidental, and significant risk of physical harm and are therefore “dangerous” recreational activities that carry an obvious risk,
including serious physical or emotional injury, property damage, physical harm or disability, or death. You (the Participant) acknowledge that Black
Rock Adventure Park and Campground, Trucks Gone Wild, Premier Mega Truck Racing, Jake Burton and all of the above's associates are not liable for negligence, breach of contract, or pursuant to any statute as a result of the materialization
of any obvious risk of harm.
In consideration of my entrance into Black Rock Adventure Park and Campground and use of its ATV park and other facilities, I agree to
indemnity and hold harmless Black Rock Adventure Park and Campground LLC, it’s Officers, Owners, Employees and Agents. Trucks Gone Wild, it's Officers, Owners, Employees and Agents, Premier Mega Truck Racing, it's Officers, Owners, Employees and Agents, Jake Burton, his Officers, Owners, Employees and Agents from any and all
liability resulting from my use of the premises and its attractions.
Black Rock Adventure Park and Campground LLC, it’s Officers, Owners,
Employees and Agents, Trucks Gone Wild, it's Officers, Owners, Employees and Agents, Premier Mega Truck Racing, it's Officers, Owners, Employees and Agents, Jake Burton, his Officers, Owners, Employees and Agents reserve the right to bring legal action against any persons that file a legal suit against Black Rock Adventure Park and
Campground LLC, it’s Officers, Owners, Employees and Agents, Trucks Gone Wild, it's Officers, Owners, Employees and Agents, Premier Mega Truck Racing, it's Officers, Owners, Employees and Agents, Jake Burton, his Officers, Owners, Employees and Agents.
I further acknowledge that said activities have both inherent and obvious risks including, but not limited to, injury and death. Black
Rock Adventure Park or its staff will not provide medical assistance in the event of an accident. You are responsible for your own
health and safety.
I understand that Black Rock Adventure Park requires helmets, safety harnesses and proper use of equipment per factory
recommendations.
I understand that during the Activities I may be photographed or videotaped. To the fullest extent allowed by law, I waive all rights of
publicity or privacy or pre-approval that I have for any such likeness of me or use of my name in connection with such likeness, and
I grant Black Rock Adventure Park and Campground and its assigns permission to copyright, use, and publish (including by
electronic means) such likeness of me, whether in whole or part, in any
form, without restrictions and for any purpose.
