Petting Farm Liability Release

PARTICIPANT WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

For and in consideration of Bambi's mini petting farm allowing me, the undersigned, to participate in the Bambi's mini petting farm event described above (the “Event” or “Events”); I, for myself, and on behalf of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree to and make the following contractual representations pursuant to this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement (the “Agreement”);

1.  I hereby represent that (i) I am at least eighteen (18) years of age or older; (ii) I am in good health and in proper physical condition to participate in the Event; and (iii) I am not under the influence of alcohol or any illicit or prescription drugs which would in any way impair my ability to safely participate in the Event. I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to participate in the Event, that I am responsible for my own safety and well being at all times and under all circumstances while at the Event site.
2. I understand and acknowledge that participation in Bambi's mini petting farm is inherently dangerous. I understand and acknowledge the risks and dangers associated with participation in the Bambi's mini petting farm, including without limitation, the potential for serious bodily injury, sickness and disease, permanent disability, paralysis and loss of life; loss of or damage to equipment/property; exposure to extreme conditions and circumstances; contact with other participants, spectators, animals or other natural or manmade objects; dangers arising from adverse weather conditions; equipment failure; inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of the Event Organizers; and other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”). I understand that these Risks may be caused in whole or in part by my own actions or inactions, the actions or inactions of others participating in the Event, or the negligent acts or omissions of the Released Parties defined below, and I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expenses which I incur as a result of my participation in any Event.
3. I agree to be familiar with and to abide by the Rules and Regulations established for the Bambi's mini petting farm. I accept sole responsibility for my own conduct and actions while participating in the Event.
4. I hereby Release, Waive and Covenant Not to Sue, and further agree to Indemnify, Defend and Hold Harmless the following parties: Bambi's mini petting farm, its Facility, Venue and Property Owners or Operators upon which the Event takes place; Law Enforcement Agencies and other Public Entities providing support for the Event; and each of their respective parent, subsidiary and affiliated companies, officers, directors, partners, shareholders, members, agents, employees and volunteers (Individually and Collectively, the “Released Parties” or “Event Organizers”), with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss or expense (including court costs and reasonable attorneys fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate in any way to my participation in the Event, including claims for Liability caused in whole or in part by the negligent acts or omissions of the Released Parties. I further agree that if, despite this Agreement, I, or anyone on my behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liabilities which any may be incurred as the result of such claim.
5. Photo/Video Release:

I hereby warrant that I am of legal age and competent to enter into this Agreement, that I have read this Agreement carefully, understand its terms and conditions, acknowledge that I will be giving up substantial legal rights by signing it (including the rights of my spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns), acknowledge that I have signed this Agreement without any inducement, assurance or guarantee, and intend for my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Agreement. This Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.

Kids Train Ride

1. Acknowledgment of Activity

I understand that the Silverton Springs Kids Train Ride is a motorized amusement-style ride that travels on a designated track or pathway around the property. The ride may include themed elements, uneven terrain, curves, tunnels, sound effects, and other features.

2. Assumption of Risk

I understand that participation in the train ride involves inherent risks, including but not limited to:

• Sudden starts, stops, or jerking motions

• Swaying or shifting movement

• Slips, trips, or falls while boarding or exiting

• Contact with fixed objects or other riders

• Minor bumps due to uneven terrain

• Weather-related conditions (heat, rain, wind)

• Fright or surprise from themed elements

• Injury caused by failure to remain seated

I voluntarily assume all risks, known and unknown, associated with participation in this activity.

3. Rider Rules and Safety Requirements

I agree that:

• All riders must remain seated at all times while the train is in motion.

• Hands, arms, legs, and feet must remain inside the train.

• No standing, roughhousing, or horseplay is permitted.

• Riders must follow all verbal instructions from staff immediately.

• Failure to follow rules may result in removal from the ride without refund.

Parents/guardians are responsible for determining whether their child is physically and emotionally able to safely participate.

4. Release of Liability

To the fullest extent permitted by Florida law, I hereby release, waive, discharge, and hold harmless Bambi’s Mini Petting Farm, its owners, employees, volunteers, agents, sponsors, and representatives from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to any loss, damage, or injury (including death) that may be sustained while participating in the train ride, whether caused by negligence or otherwise.

I understand that this release includes any claims based on ordinary negligence.

5. Indemnification

I agree to indemnify and hold harmless Bambi’s Mini Petting Farm from any claims brought by or on behalf of a minor or participant as a result of participation in the train ride.

6. Medical Authorization (For Minors)

In the event of an emergency, I authorize Bambi’s Mini Petting Farm staff to obtain medical treatment for the minor participant if I cannot be reached immediately. I understand that I am financially responsible for any medical treatment provided.

7. Photo and Media Release

I grant permission for photographs or videos taken during participation to be used for promotional or marketing purposes without compensation, unless I notify management in writing prior to participation.

8. Acknowledgment of Understanding

I have read this agreement carefully and understand its contents. I understand that I am giving up substantial legal rights by signing this document. I sign this agreement voluntarily.

Capybara Encounter

Acknowledgment of Risk

I understand that interacting with animals—including capybaras—can involve inherent risks. These risks may include, but are not limited to: Bites, scratches, or nips Sudden movements or unpredictable behavior Allergic reactions Slipping, tripping, or falling around animals or equipment I acknowledge that Bambi’s Mini Petting Farm staff provide rules and safety instructions for my protection and the animals’ welfare, and I agree to follow all instructions at all times.

Health & Safety Agreement

I certify that: I am physically able to participate in this activity. I will not intentionally provoke, chase, or handle the animals improperly. I will not place my hands near the animals’ mouths. I will use the provided feeding tools (such as tongs) when instructed. I will supervise any minor participant in my care at all times.

Liability Release

In consideration for being permitted to participate in the Capybara Encounter, I hereby: Release and discharge Bambi’s Mini Petting Farm, its owners, employees, volunteers, agents, and affiliates from any and all liability, claims, demands, or causes of action arising from or related to participation in this activity. Assume full responsibility for any risk of injury or property damage that may occur as a result of participation. Agree not to sue Bambi’s Mini Petting Farm for any injury, harm, or damages resulting from this activity, except in cases of gross negligence or intentional misconduct.

Media Release

I grant permission for Bambi’s Mini Petting Farm to use photos or videos taken during the encounter for promotional purposes. Parent/Guardian Consent (Required for Participants Under 18) I, the parent/legal guardian of the above minor, have read and understand this liability release, and I consent to their participation in the Capybara Encounter. I agree to all the terms on their behalf.

Age Requirement:

I understand and agree that my child is 8 years of age or older. If your child is under the age of 8 that child or children need to be accompanied by a paying adult.

Animal Feeding

Assumption of Risk

I understand that participation in animal feeding activities, including but not limited to camels, cows, and capybaras, involves inherent risks. These risks may include, but are not limited to, scratches, bites, kicks, slips, falls, allergic reactions, or other injuries caused by animals, equipment, or the environment.

I acknowledge that animals are unpredictable by nature and that even well-trained animals may behave unexpectedly.

Rules & Safety Acknowledgement

I agree to follow all rules and instructions provided by Bambi’s Mini Petting Farm staff, including but not limited to:

• Feeding animals only with provided food and tools (such as tongs)

• No hand feeding Capybara's

• Keeping hands away from animals’ mouths

• Not running, yelling, or making sudden movements

• Supervising children at all times

• Immediately reporting any injury or unsafe condition to staff

Failure to follow rules may result in removal from the activity without refund.

Release of Liability

In consideration of being allowed to participate in this activity, I hereby release, waive, discharge, and hold harmless Bambi’s Mini Petting Farm, its owners, employees, volunteers, agents, and affiliates from any and all claims, demands, actions, or causes of action arising out of or related to participation in the animal feeding activity, including claims resulting from negligence, to the fullest extent permitted by law.

Medical Consent

I authorize Bambi’s Mini Petting Farm staff to obtain emergency medical treatment for myself or my child if necessary. I understand that I am responsible for any medical costs incurred.

⚠️ FLORIDA AGRITOURISM WARNING

Under Florida law, an agritourism operator is not liable for injury to or death of a participant in an agritourism activity conducted at this agritourism location if such injury or death results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury or death. You are assuming the risk of participating in this agritourism activity.
