LIABILITY WAIVER AND PHOTO RELEASE
General Liability Waiver
I, for myself, my estate, my heirs, personal representatives or assigns, do hereby forever release and waive my right to bring suit against American Bird Conservancy (“ABC”), and/or any other organization participating with ABC in ABC’s SPLASh program activities, and/or any of their officers, employees, trustees, volunteers, agents and/or representatives from any liability, claims, demands and/or causes of action for any loss, damage or injury, including any exposure to or infection with the Covid-19 virus and/or any of its variants, sustained in connection with my participation in any ABC SPLASh program activities, except for ABC’s or the participating organizations acts of gross negligence or deliberate misconduct.
Photo Release
I hereby grant the American Bird Conservancy (“ABC”) permission to use photographs and/or videos of me during all activities in any of its publications, including web-based publications. I understand and agree that ABC is the exclusive owner of all rights in the photos/videos, including copyrights.
I hereby also authorize ABC to exhibit, publish, or distribute these photos/videos for any lawful purpose, and I waive any right to approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photos/videos.
I, for myself, my estate, my heirs, personal representatives or assigns, do hereby forever release and waive my right to bring suit against ABC and/or its officers, employees, trustees, volunteers, agents, and/or representatives from any liability, claims, demands, and/or causes of action arising from or in connection with this authorization and/or ABC’s use of the photos/videos.
Choice of Law and Duration
The law of the District of Columbia will apply to this Liability Waiver and Photo Release, without regard to its choice-of-law provisions.
